Arizona Man Donald Day JR, 60, was arrested by FBI agents in December 2023 and accused of threats to public figures and agents of application of the law and illegal possession of firearms in the United States.
Day filed statements of non -guilty to all charges in the Arizona district court in May 2024.
Day supposedly sent messages about a “Christian ideology at the end of the days” known as premilenialism to the members of the trains family in Queensland between May 2021 and December 2022.
The 46 -year -old Nathaniel brothers, and Gareth Train, 47, used high -power rifles during an ambush to kill agents Matthew Arnold, 26, and Rachel McCrow, 29, in a remote property in Wieambilla west of Brisbane, on December 12, 2022.
Nathaniel Train joined Gareth and his brother Stacey, 45, to fatally shoot the neighbor Alan Dare, 58, shortly after killing the two agents.
The lawyer of Day, Jon Sands, presented a motion prior to the trial in the district court of Arizona of the United States in early March asking that certain evidence be inadmissible, including the testimony of eight Queensland police officers presented by the Prosecutor’s Office.
“Carefully control the admissibility of evidence about trains and shooting, acts for which Day has no responsibility, is the only way to ensure that Day receives a fair trial,” Sands said in his motion.
The three trains were shot dead by specialized police officers hours after the ambush in December 2022 when they refused to negotiate or surrender.
Sands accused the Australian authorities of the orientation of the day for shares and legal speech in the United States because all the real suspects were dead.
“The court must limit the admitted evidence on Wieambilla’s shooting to a stipulated statement of facts,” Sands said.
“This approach … provides the entire context necessary for the Government to demonstrate its case, without requiring the emotionally loaded testimony of the officials responsible for enforcing the Australian law.”
A coronial investigation in the shootings in 2024 heard that trains had paranoid beliefs, including that they were part of a final battle with Satan and the police was “demons” that would transform the family into meaningless slaves.
Sands said Federal Prosecutors of the United States would try to claim the day and trains had isolated lifestyles and similar anti -government beliefs.
“The Government has indicated that it intends to introduce into the trial a great volume of evidence related to the trains and the shooting of Wieambilla,” Sands said.
The Queensland police service was presented to the statements of witnesses of the United States Court of eight officers, including a terrorism command investigator who reviewed the alleged online interactions and on social networks between trains and the day.
Witness statements contained accusations that the Queensland police used forensic software to hack iPhones found in the property of trains and discovered messages exchanged on day on websites to share videos.
Day must be tried in the United States District Court at the end of April.
