A US federal judge warned that he could keep the Trump administration contempt for violating his orders to reverse aircraft transported to El Salvador.
US district judge James E. Boasberg said he found “likely cause” to keep the administration in criminal contempt and warned that he could refer the case for prosecution if it did not “pure” its contempt.
If the government does not purify the contempt, a judge can impose daily fines or even order someone, NBC News reports.
Mr Boasberg said the administration could do so by returning to the US to the EL Salvador Prison.
That, he said, “can use themselves from their right to challenge their remediability”.
“The Constitution does not tolerate intentional disobedience of judicial orders – especially not by officials of a coordinate branch who swore an oath to maintain it,” the judge wrote.
If the Justice Department refused to prosecute the case, Judge Boasberg said he would appoint another lawyer to prosecute the contempt.
It is a significant escalation in the constant tension between the judicial and executive branches of the US government during the second term of Donald Trump.
Parts of the US President’s legislative program have been discontinued by judges, as the administration extends against the limitations of the separation of powers.
Mr. Trump previously asked that Judge Boasberg be charged while the Justice Department claimed to have surpassed his authority – both reflect the administration’s efforts to overcome perceived obstacles to the implementation of his agenda.
The administration of Mr. Trump also argued that it did not violate any commands.
It is alleged that the judge did not include a turnaround in his written order and said the aircraft had already left the US by the time the order came off.
The core of the legal battle is Kilmar Abrego Garcia, a man sent to El Salvador by the Trump administration in March, despite an immigration court that prevented his deportation.
The US Supreme Court has called on the administration to facilitate his return, but Trump officials have claimed that Mr. Garcia ties with the MS-13 gang.
The advocates of Mr. Garcia argued that there is no evidence of this.
All this comes after the president of El Salvador, Nayib Bukele, visited the White House earlier this week.
During his time with Mr. Trump has Mr. Bukele said he would not return Mr. Garcia, and compared it to smuggling “a terrorist in the United States.”
