But the government’s application did not resolve the judge’s request for the government to provide detailed steps to return Kilmar Abrego Garcia to the United States. The government only stated that Garcia was under the authority of the El Salvador government.

The document comes a day after a day after U.S. government attorneys worked to provide U.S. District Judge Paula Xinis with any information about Garcia’s whereabouts. Sinis issued an order after Friday’s hearing, asking the government to disclose Garcia’s “current actual position and custody status” and “the defendant will take (and when) to promote his reward.”

“Based on my understanding of the official reports at the San Salvador Embassy, Abrego Garcia is currently being held in the terrorist confinement center in El Salvador,” Kozak’s statement said. “He is still alive and safe in the facility. He is detained under the sovereignty, the domestic authority of El Salvador.”

Kozak’s statement did not meet the judge’s latter request.

On Friday, the government was angry about lack of information.

“Where is his authority with?” the judge asked at the hearing. “I’m not asking for a state secret. All I know is that he’s not here. The government is forbidden to send him to El Salvador, and now I’ve asked a very simple question: Where is he?”
