The 17-year-old man charged in the death of Austin Metcalf in a Frisco, Texas, reduced his mortgage on Monday and was released on house arrest.
A Judge in Collin County agreed to lower the mortgage of Carmelo Anthony from $ 1 million to $ 250,000 and ordered the teenager to carry a single monitor and stay in his parents’ home.
Anthony’s bandage was placed and he was released on Monday afternoon, according to Fox 4 News. After his release, he made no statements.
After his release, one of Anthony’s defense lawyers, Mike Howard, suggested that the teenager would claim self -defense in his upcoming trial.
“Every Texan deserves the right to defend themselves if they reasonably fear their lives,” Howard told the press outside the court. “Self-defense is a protection that applies to each of us. There are two sides to each story. Carmelo is a 17-year-old child and an excellent student. He is the captain of his track team and the captain of his football team. It is a tragedy for both families.”
On April 2, Anthony was discussed in Collin County Prison after he was allegedly stabbed and killed at a track event.
According to witnesses, Metcalf and Anthony became involved in an oral confrontation, which ended when Anthony allegedly stabbed Metcalf once in the chest.
According to an arrest report, Anthony complied with officers and asked police if Metcalf would be in order and whether his actions would be considered self -defense, CBS News reports.
The first move to the teen’s defense lawyers was to reduce Anthony’s bandage.
Anthony’s defense lawyers questioned the teenager’s father during a hearing on Monday. His father said Anthony was an ‘A’ student and the captain of his football and track teams.
He also told the court that he was the only supplier and could not afford the $ 1 million mortgage.
Prosecutors, who did not call one of their own witnesses, questioned Anthony’s father and asked about a separate case of ‘assault’ after which Anthony was allegedly involved on February 4.
They also asked why the family did not use donations that their son came in to pay his mortgage.
“We don’t have access to the money,” Anthony’s father said.
The defense lawyers made it clear that the money raised – $ 412,000 – was not “an bond fund” and was used by the parents to pay for their rent and bills as they had to take time to hire the work and rent attorneys to handle their son’s legal battle.
“This family should be able to survive. There was a tremendous amount of pressure,” said attorney Mike Howard. “I think at this point, when I live in a fenced community, the safety of their younger children is very justified. Safety details and criminal defense are not cheap. ‘
Prosecutors have requested that Anthony’s $ 1 million mortgage remain unchanged, arguing that the solid mortgage fee is standard for murder cases in Collin County.
Collin County District Attorney Greg Willis said the state would continue to pursue the facts in the case, but noted that the murder had caused increased emotions in the Texas community.
