GLADVALE FARMS LTD has committed the offense on two occasions in October 2019 on a North Oreti Plains farm.
The company was convicted today after being considered guilty in February after a trial of August 2024.
The legal action against the company began when Southland’s environment claimed that the resource management law was violated by discharge of effluents in or on land, which could have resulted in the entry of contaminating water.
It was claimed that the defendant irrigated at night without monitoring because the employees are out of service.
The trial said that although it was not necessary to prove that the contaminant had entered or impacted the waterway, there was enough evidence to show it.
The measures taken to mitigate the discharge were not enough, including the use of a excuator to move further to a paddock.
Appearing by Christchurch’s video feed, Judge Steven told court that 90% of the fine would go to the board.
GLADVALE FARMS LTD operates five dairy farms in Southland, with 3700 cows at 3300 acres (1335ha), according to your website.
The material had already reported fines against the company of $ 27,000 in 2018/19 and $ 18,750 in 2017.
