Judge blocks administration from deporting noncitizens to 3rd countries without due process

On Friday, a federal judge blocked the Trump administration from deporting non -iconic countries other than their place of origin without a proper process.

US District Judge Brian Murphy has issued an order that prohibits the Trump administration from deporting any unnatural country that is not explicitly mentioned in their order or removal without first allowing them to raise concerns about their safety.

“The defendants claim that the United States can send a deportable foreigner to a country, not from them, not where they have ordered an immigration judge, where they can be tortured and killed immediately, without giving this person to tell the deporting authorities that they face serious danger or death.

“All nine meetings of the United States Supreme Court, Assistant Advocate of the United States, Congress, common sense, basic decency and this court disagree.”

The decision reaches an obstacle to the Trump administration policy to eliminate non -citizens in countries such as Salvador, Honduras or Panama, even if the non -iconic do not have an order to remove these countries.

The Trump administration last month referred to the Law on Enemy Aliens to deport two planets of alleged members of the Venezuela gang in the Cecot mega-prison in El Salvador with a small process.

Judge Murphy noted that the Trump administration employees “have applied and will continue to implement the alleged alien policy in third countries without notice and the opportunity to be heard for claims based on fear-with other words without a proper process.”

He said his order prevented the irreparable harm of sending non -iconic countries where they may encounter persecution, torture or death without being able to dispute their removal in court.

“The invariable factor of harm also weighs on the benefit of the plaintiffs. Here, the threatened harm is clear and simple: persecution, torture and death. It is difficult to imagine harm more harm,” he writes.

The Judge Murphy’s order requires the Trump administration to provide a written notification of non -citizenship before being removed in a third country, as well as a “meaningful opportunity” to raise concerns about their safety, including providing at least 15 days to reopen their immigration proceedings.

It also certifies a class – which means that the order applies not only to the claimants in the case, but also to any unusual with a final removal order.

Separately, Judge Murphy is considering whether Trump’s administration has violated his recent temporary restraining order when she has removed at least three men in Salvador without allowing them to concern their safety. He is still considering this question.
