The notorious gangland figure, Tony Mokbel, has offered a bail of $ 500,000 to be released on bail, and will accept strict conditions, including GPS monitoring.
The 59 -year -old man, who is serving a 26 -year prison sentence for drug trafficking, arrived at the Court in a Bearcat vehicle armored by the Victoria Police today.
Mokbel is asking the Court of Appeal to release him on bail before his long -awaited lawyer X appeal, which would be his first taste of freedom since he was arrested in Greece in 2007.
Dressed in a black suit and a blue tie, Mokbel smiled while winking and greeted his followers when he was taken to court, flanked by four officers from special operating groups.
Mokbel was imprisoned in 2012 after reaching an agreement with prosecutors and declared himself guilty of two traffic charges of a dependency drug, being MDMA and Methaphetamine.
Now he is appealing all his convictions, since he was represented by the ‘lawyer X’ Nicola Gobbo, whom he did not know he was informing the Victoria Police at that time.
His lawyer Julie Condon KC said that Mokbel had provided a $ 500,000 property in Yallambie as a guarantee to ensure her release on bail, which Jane Dixon asked if she could provide more equity.
She said she would look for advice on that during lunch.
Condon said Mokbel would agree with a series of “strict bail” conditions that include a GPS monitoring device, and would live in a stable residence in ViewBank, northeast of Melbourne.
Mokbel has strong ties with jurisdiction due to a “support family” and “long -term facto relationship,” said Condon.
He detailed seven reasons why Mokbel fulfilled exceptional circumstances to receive an appeal bond, including the moment of his appeal, his poor health and his circumstances in custody.
Condon said his non -child period has been scheduled for release by 2031, and his appeal hearing is expected to be heard at the end of this year.
“It is not an insignificant issue that the court listens to a request by which the applicant … will have fulfilled a substantial part of his non -child state sentence before his appeal is heard,” he said.
He detailed a pre-appropriate pre-appropriate judgment of the judge of Nueva Gales del Sur, Elizabeth Fullerton, which was delivered in December.
The ruling was critical about Gobbo’s role as an informant while acting as a lawyer for Mokbel and criticized the Victoria Police for her use as an informant.
Judge Fullerton discovered that the Police had perverted the course of justice in a “joint criminal company” with Gobbo to have accused Mokbel, and criticized police failure to obtain legal advice before being registered as an informant.
“The very use of a criminal lawyer as an informant registered by the Victoria Police had no precedents,” said Condon, reading the judge’s findings.
Gobbo, a registered police informant from 2005 to 2009, acted as a lawyer for Mokbel for four years before fleeing to Greece in 2006.
He has been in custody since he was arrested in Greece in June 2007 and accused of several drug trafficking crimes.
She continued advising her when she was extradited in 2008, and did not know her condition as an informant until the Superior Court raised Gag’s orders in 2018.
